Hammerberg partners Doug Chiu and Joel Zanatta were counsel in the Supreme Court of BC in Ali v. Padam, 2017 BCSC 1849 acting for our client Ms Ali who had been seriously injured in a car accident. The trial resulted in an award for our client of $789,279.19 plus costs and disbursements.
The award included compensation for pain and suffering sustained due to a disc injury to Ms Ali’s lower back which required spinal surgery, as well as for psychiatric injuries including major depression and Post Traumatic Stress Disorder. The largest portions of the award were for Ms. Ali’s income loss. Unable to return to her previous occupation as a salesperson, she was compensated for not only her missed time, but also for her reduced prospects in the job market as after the accident she found herself less capable of earning income, less marketable to potential employers, unable to take advantage of all job opportunities, and less valuable in a competitive labor market.
Ms. Ali was also reimbursed for her out of pocket medical expenses, and was given an award for future treatment and rehabilitation costs. Please click here to read the full decision.
