Partner Krista Simon and Associate Kevin Yee were counsel in the Supreme Court of BC in Lim v. Busha, 2019 BCSC 1223, where our client successfully pursued compensation for harms caused by three car accidents.
Ms. Lim is a Registered Physiotherapist who was injured in three car accidents that were not her fault. As a result, her health suffered greatly, and overall, all aspects of her life – including her ability to work and pursue recreational activities – have suffered. Krista and Kevin achieved an exceptional result for our client – a total judgement of over $1.131 million.
A large part of the judgement was for the negative impact to Ms. Lim’s future earnings stream. Prior to the accident, Ms. Lim was a healthy and fully capable physiotherapist; but, the accidents changed that. Ms. Lim has been limited in the nature and amount of work she can take on due to her injuries. Thus, both past and future loss of earnings were part of the award. Ms. Lim’s out of pocket expenses were reimbursed to her, and an award was made for her likely future expenses as well, since she continues to need ongoing support and treatment. Another significant part of the award is for pain and suffering, loss of enjoyment of life, and loss of amenities. This award is made taking into account such things as Ms. Lim’s age, likely permanence of the injuries and the way in which the injuries altered her realistic life plans. Friends, family members, treatment providers and past coworkers testified in support of Ms. Lim’s case.
